Licence Agreement

Effective · Paste Tense for Mac and the offline decryptor it saves

The short version

When you buy Paste Tense on the Mac App Store, Apple's standard licence applies. On top of it we add a few plain terms: your history is yours and stays on your Mac, back up your files and keep your recovery key safe, and we can't recover a lost password or recovery key because we never have them. These terms never reduce your rights under Apple's licence or under the law where you live.

Apple's standard licence

Paste Tense is licensed, not sold. When you get it from the Mac App Store, your use of the app is governed by Apple's Licensed Application End User License Agreement (the "standard EULA"). It is the agreement between you and us, the developer, for the app.

Our supplemental terms

The terms below are specific to Paste Tense and add to the standard EULA. They are between you and the developer of Paste Tense ("we", "us"), not Apple.

These supplemental terms never reduce your rights under the standard EULA. If anything here conflicts with it, the standard EULA wins. Our Promise is an additional commitment from us, and nothing in either agreement takes it away.

1. Your data is yours

Everything Paste Tense records belongs to you. It stays on your Mac and in the folders you choose; the app never sends it anywhere and we never receive it. We claim no rights to it. You can read, move, copy or delete your history files at any time, with or without the app.

2. Your backups and your keys

Because we never have a copy of your history or your keys, we cannot recover them. Keeping them safe is in your hands:

  • Back up your files. Use Paste Tense's backup folder, Time Machine or both. Files can be lost to disk failure, deletion, a folder that is moved or a sync service that misbehaves.
  • Keep your recovery key. If encryption is on and you lose both your password (or, with a Mac-login unlock, the Mac itself) and your recovery key, nobody — including us — can open your encrypted history.

To the extent the law allows, we are not responsible for history that cannot be opened because a password, recovery key, key file or Mac was lost, since we have no way to recover any of them.

3. What is recorded, and using it responsibly

Paste Tense skips items other apps mark as secret and copies from apps you exclude, but both depend on conventions and on what macOS reports: a secret no app marked is recorded like any other text. Please read what the app and the Privacy Policy say about these limits. Use Paste Tense lawfully and in line with the rules of whoever owns or manages the Mac you use it on — for example, your employer's policies about where work information may be kept — and don't use it to record other people's information without the right to do so.

4. Warranty

The standard EULA sets out the warranty position: to the fullest extent the law allows, the app is provided "as is", and if it fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price. We give no further warranties beyond those the law requires. Nothing here excludes a warranty or a right that consumer law where you live does not allow to be excluded.

5. Liability

Our liability is limited as the standard EULA sets out, to the fullest extent the law allows. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for fraud, or for death or personal injury caused by negligence.

6. Support, maintenance and claims

We, not Apple, are responsible for Paste Tense and its content. Support comes from us at support@pastetense.app; Apple has no obligation to provide maintenance or support for the app. We, not Apple, are responsible for addressing any claims about the app or your use of it — such as product liability claims, claims that it fails to meet a legal or regulatory requirement, claims under consumer protection or privacy law, and claims that it infringes someone else's intellectual property.

7. Updates

We may release updates through the Mac App Store. We are not obliged to release them on any schedule, but an update will never remove functionality you paid for or turn Paste Tense into a subscription, within the honest limits set out in Our Promise. A newer version may need a newer version of macOS.

8. Export rules

Paste Tense uses standard encryption built into macOS to protect your history. Some countries regulate exporting software that contains encryption. As the standard EULA says, you may not use, export or re-export the app except as United States law and the laws of the place where you obtained it allow — in particular, not to a country under a U.S. embargo, or to anyone on a U.S. government list of restricted persons. By using the app you confirm that you are not in such a country and not on such a list.

9. Apple as a third-party beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of this agreement. Once you accept it, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

10. The offline decryptor

In addition to the standard EULA, we give you permission to keep, copy and use the decryptor page Paste Tense saves for you on any computer or device, to read your own files or files you have the right to read. Its website copy is covered by the Website Terms of Use.

Governing law

The standard EULA names the law that governs it. These supplemental terms are governed by the laws of [Governing law: to be completed before launch], without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.

Changes to these terms

If we change these supplemental terms, we will publish the new version here with a new effective date. A change will never weaken Our Promise for a version you already have.
